Ducks2Water Swim School Terms and Conditions

  1. In these Terms and Conditions “We”, “Us” or “Our” refer to Ducks2Water LLP. “You” or “Your” refer to the person who made the booking or the parent or carer of the child, as appropriate.
  2. You and We agree that all bookings for swimming lessons, whether booked online or in any other way, are subject to these Terms and Conditions.
  3. All lessons must be paid for in advance. A place in a lesson is not confirmed until payment has been made. Any statement made about availability does not confirm a place until payment has been received. A child will not be admitted to a lesson if fees have not been paid.
  4. Payment for lessons is made by monthly subscription. The subscription amount remains the same each month regardless of the number of lessons in that month. You must pay the subscription every month. If a payment is not made on the due date, the booking system may make the lesson available to another person. It is Your responsibility to ensure sufficient funds are available and that payment card details in Your Ducks2Water account are kept up to date.
  5. One calendar month’s notice is required to terminate a subscription. To terminate at the end of a particular month, notice must be given before the first day of that month. No credit or refund is given for part months. Notice must be provided in writing by emailing contact@ducks2water.com. Once notice is given, payment will not be taken on the next 1st of the month, but attendance may continue during the notice period.
  6. No refund will be given for lessons not attended for any reason, including illness, holidays, or inability to attend.
  7. If Ducks2Water cancels a lesson (for example due to pool closure or teacher unavailability), Your account will be credited. Credit values are shown on the Policies & Payments page of the website.
  8. If a lesson cannot be held, notification will be sent by SMS to the mobile number You have provided.
  9. Lessons last 30 minutes. This includes time for entering and exiting the pool. Teaching time is approximately 25 minutes.
  10. You must inform Us of any relevant information about the child, including medical conditions or individual needs. This information will be treated as strictly confidential.
  11. Your information is stored in accordance with the UK General Data Protection Regulation. It is used only for managing bookings and lessons. Information is also stored by our booking provider (Udio Systems) and payment provider (Stripe). We do not share Your information with any other third parties.

    Payment card details are stored only by Stripe. Neither Ducks2Water nor Udio Systems have access to these details.
  12. You agree that We may contact You by SMS or email using the details You have provided to keep You informed about lessons, swimmer progress, and important updates.
  13. You must not bring a child with an infectious illness or condition to lessons, including (but not limited to) ear infections, diarrhoea, chicken pox, impetigo, conjunctivitis, or severe colds.
  14. A child must not enter the pool until advised by the teacher. You are responsible for the child’s behaviour. If behaviour is disruptive, We may ask for the child to be removed from all or part of the lesson. No refund or credit will be given.
  15. Photography or video recording is not permitted during group lessons. In One-to-One lessons, photography or video may be taken with the teacher’s agreement. This may also apply to Duo or Trio lessons where children are from the same family.
  16. We may arrange photography or video recording of lessons. Such material will only be used where a signed Consent Form has been provided. Consent may be withdrawn at any time by notifying Us in writing.
  17. You are fully responsible for Your own and the child’s property. We accept no responsibility for loss or damage.
  18. Where on-site parking is available, You must park considerately. Neither We nor the facility owner accept responsibility for the security of vehicles or their contents.
  19. We take reasonable steps to ensure pool facilities are suitable; however, We accept no liability for injury caused by defects in the premises. Any claims relating to such defects must be directed to the pool proprietors.
  20. We reserve the right to amend these Terms and Conditions. If changes are made, You will be notified by email. If You make a new booking after previous bookings, You should review the Terms and Conditions to ensure You are aware of any updates.
